Estate/Family Division Survey
Quite often Family and Estate Surveys consist of multiple parcels of land that have been passed down from generation to generation to preserve a family’s heritage or legacy. The results of Family and Estate Division surveys are usually the same as a boundary survey or informal subdivision to split property between heirs based on wishes of the grantee (often parent) through a will or court decision if a will not in place and parties cannot agree upon the split. The intent often is to divide an estate left to a family based on the Grantors wishes or Courts decision which can be very trying for all parties involved as emotions are normally heavy due to the loss of a loved one. These often are conveyed through a will or judgement of the court if parties cannot agree upon an equitable split of the property.
It is the surveyor’s duty to follow the guidance laid out to ensure the property is divided in accordance with the documentation provided. Furthermore, adequate access to all properties created are needed to provide that land does not become landlocked and that utilities can serve the individual properties should they be developed or sold to an outside party in the future.
